TERMS & CONDITIONS

1. Scope


These Terms and Conditions apply to all photography services provided by LUSÉA Photography.


2. Booking and Contract Formation


A contract is formed once a booking has been confirmed in writing by signed agreement, email, message or invoice acceptance.


3. Services


The scope of services is defined in the individual quotation, proposal, or booking confirmation.


4. Fees and Payment


All fees are specified in the quotation or invoice.


Invoices are payable within 14 days unless otherwise agreed.


No usage rights are transferred until full payment has been received.


5. Cancellation and Rescheduling


Clients may request a rescheduling subject to availability.


Cancellation fees may apply as follows:

  • More than 30 days before the session: no charge
  • 14–29 days before the session: 30% of booking value
  • 7–13 days before the session: 50% of booking value
  • Less than 7 days before the session: 100% of booking value


6. Client Delays


Any delay by the client will reduce the available photography time accordingly without entitlement to a refund.


7. Artistic Style and Editing


The client acknowledges familiarity with the photographer's portfolio and artistic style.


Editing decisions remain at the sole discretion of the photographer.



8. Delivery of Images


Images will be delivered digitally via passwort protected online gallery incl. download link.


Delivery times are induvidal and guaranteed in writing before the session.


9. Copyright


The photographer retains full copyright ownership of all photographs.


10. License and Usage Rights


Private clients receive a non-exclusive, non-transferable license for personal use.


Commercial use, publication, resale, advertising, or transfer to third parties requires prior written permission.


11. Portfolio and Marketing Use


The photographer may use photographs for portfolio display, website publication, social media, competitions, exhibitions, and marketing purposes.


Clients may opt out by providing written notice before the photography session.


12. Limitation of Liability


Liability is limited to cases of intentional misconduct or gross negligence to the extent permitted by law.


The photographer is not liable for circumstances beyond reasonable control, including technical failures, equipment malfunction, internet disruptions, or force majeure events.


13. Illness and Force Majeure


In the event of illness, accident, severe weather, government restrictions, or other force majeure circumstances, both parties shall make reasonable efforts to arrange an alternative date.


14. Data Protection


Personal data will be processed in accordance with the Privacy Policy.


15. Governing Law and Jurisdiction


These Terms and Conditions are governed exclusively by Swiss law.


The place of jurisdiction shall be the registered place of business of the photographer, unless mandatory legal provisions provide otherwise.
